The legalization of nationwide sports betting has been gaining some traction, although the major sports leagues, such as the NBA, NFL, etc., continue to fight it in the courts.
Should legislation eventually make its way to Congress, there could already be a law on the books that could help with the drafting of new regulations.
In a recent article for the Legal Sports Report, Ryan Rodenberg writes that the Interstate Horseracing Act – enacted in 1978 – could be a template for any future nationwide sports gambling legislation.
Specifically, Rodenberg points out, one part of the 40-year-old law remains “particularly relevant” today – “Congress finds that the States should have the primary responsibility for determining what forms of gambling may legally take place within their borders.”
Rodenberg believes that it would only require minor adjustment to the current law in order for it to apply to expanded legalized sports betting.
